Short-Term Rental Agreement

(Intended for occupancy of 30 days or less)

1. Occupant

The “Occupant” agrees as follows:

Occupant rents, for short-term purposes only, the furnished real property and improvements described as: Premises noted on the Waters End Properties Booking Site. The Premises has bedroom(s) and bath(s) as described on the Waters End Booking Site.

3. Arrival and Departure

4. Authorized Use and Guests

The Premises are for the sole use as a short-term residence by the Occupant named on the Waters End Properties Booking site and, in addition, not more than the adults and children specified in the property description.

5. Payments

Occupant agrees to the payments outlined on the Waters End Properties Booking Site. The Premises will not be held for the Occupant until this Agreement is agreed to, and if applicable, the Booking Deposit has been received by the Owner or Owner’s Representative.

6. Damage Deposit

The damage deposit will be transferred to and held by the Owner. Upon termination of occupancy, it may be used as reasonably necessary to cover any default, damages, cleaning, or replacement of property as per the Agreement terms.

7. Cancellation Policy; Refund

If Occupant cancels or terminates this Agreement, specific terms apply as outlined in this section, based on timing and other conditions.

8. Unauthorized Holding Over

Any unauthorized holding over by the Occupant is subject to additional charges and potential damages.

9. Cleaning

The Premises will be professionally cleaned, and Occupant is expected to leave it in the same condition. Additional cleaning charges may apply if required.

10. Animals

Animals are not allowed without the Owner’s prior written consent, unless stated otherwise by law or the booking site.

11. No Smoking

Smoking is strictly prohibited on the Premises and common areas. Violations may result in eviction and forfeiture of deposits.

12. Condition of Premises

Occupant shall inspect the Premises on arrival and report any issues immediately.

13. Utilities

Owner will pay for all utilities.

14. Rules, Regulations, and No Commercial Use

Occupant agrees to comply with all rules and regulations posted on the Premises and shall not use it for commercial purposes or any illegal activity.

15. Condominium/Planned Unit Development

If applicable, Occupant agrees to comply with all HOA rules and may be responsible for fines resulting from violations.

16. Maintenance

Occupant is responsible for proper use and reporting any issues immediately. Costs for repairs due to misuse or negligence may be billed to the Occupant.

17. Alterations

No alterations to the Premises are permitted without prior consent from the Owner.

18. Entry

The Owner or representatives have the right to enter the Premises under specified conditions.

19. No Assignment or Subletting

Occupant shall not assign or sublet the Premises.

20. Unavailability

If the Premises are unavailable, the Owner may substitute a comparable unit or cancel the Agreement with a full refund.

21. Occupant’s Obligations Upon Termination of Occupancy

Occupant shall vacate and return the Premises in good condition as received, excluding ordinary wear and tear.

22. Personal Property and Injury

Owner’s insurance does not cover Occupant’s personal property or injuries except for certain conditions. Occupant is advised to obtain insurance.

23. Mediation

Occupant agrees to mediate any disputes before resorting to legal action.

24. Joint and Individual Obligations

If there is more than one Occupant, each is responsible for fulfilling all obligations jointly and individually.

25. Transient Occupancy

Occupant is renting as a transient lodger, and the Owner retains all legal rights.

26. Keys; Locks

Details about keys, locks, and access devices are provided upon arrival. Occupant agrees to return all devices upon departure.

27. Other Terms and Conditions

Check-in procedures will be emailed to the guest 48 hours prior to arrival.

28. Entire Contract

This Agreement constitutes the entire contract and is governed by the laws of California. Any modifications must be in writing.
